The technical regulations of the Customs Union 'On safety of agricultural and forestry tractors and their trailers'

As of February, the 15th,​ the technical regulations of the Customs Union (CU) 'On safety of agricultural and forestry tractors and their trailers' came into effect, having being approved by the CU Board Decision # 60 as of July, the 20th 2012.

Said technical regulations establish the requirements, mandatory for application and execution, to wheeled and full track type agricultural and forestry tractors and their trailers to ensure the free circulation of wheeled and full track type agricultural and forestry tractors and their trailers released for marketing on the common customs territory of the CU.

Given the accepted practices, including the European ones, the Decision by the EEC # 181 as of October 2, 2012 sets forth the transition periods for the document to enter into force. The opportunity to produce and release into distribution the products compliant with the mandatory requirements established earlier by Customs Union (CU) and Common Economic Space (CES) regulatory legal acts or legislation by a CU Member State and CES has been provided up to March 15, 2017, given the documents on the compliance of the products with said mandatory requirements were issued or accepted before February 15, 2015. The circulation of such products is allowed within its service life period set forth as per CU and CES Member State legislation.

The documents on the products' compliance assessment (validation) with said mandatory requirements established by the CU and CES as well as CES Member State legislation issued or accepted with regard to the products, being an object of technical regulation as per the technical regulations before their entrance into force, are in force until their service-life expiration but not later than February 15, 2017. 

Until October 1, 2015, it is allowed to produce and release into circulation products which were not subject to the mandatory compliance assessment (confirmation) before the technical regulations commencement date as per the CU and CES regulatory legal acts or CES Member State legislation on the CU territory without documentation on mandatory compliance assessment (validation) and without a relevant labelling with a national compliance mark (a sign of the marketing circulation).

As of the public release day for technical regulations 'On safety of agricultural and forestry tractors and their trailers' at the official EEC web-site on the Internet, the manufacturers, importers, and compliance authorities of the CU and CES Member States of said products were provided an opportunity of getting acquainted with the application of the unified requirements specified in the technical regulations and getting ready for their subsequent stage-wise implementation.

After February 15, 2015, the issuance or the acceptance of documentation on compliance assessment (validation) of the products regarding the mandatory requirements established earlier by the CU and CES regulatory legal acts or a CU and CES Member State legislation is not permitted.

The objects of the technical regulation, in view of the technical regulations, are the newly manufactured and imported wheeled and full track agricultural 

and forestry tractors and their trailers released into circulation on the common customs territory of the CU irrespective of the country of origin. The CU technical regulations cover the tractors and trailers with maximum estimated speed 6 km/h. 

The CU technical regulations also cover the newly manufactured or imported tractor and trailer components affecting their safety and released into circulation on the common customs territory of the CU separately from tractors and trailers irrespective of the country of origin The list of the components covered by the requirements of the CU technical regulations 'On safety of agricultural and forestry tractors and their trailers' is set forth in Addendum 1 to the CU technical regulations.

Before their release into circulation, tractors, trailers or components must undergo the confirmation of their compliance with the safety requirements of the CU technical regulations 'On safety of agricultural and forestry tractors and their trailers'. 

Tractors, trailers and components are subject to the confirmation of compliance in a form of certification (as per the schemes 1c, 3c and 4c).

Issues regarding the application of the technical regulations' requirements, including the technical regulations of the CU 'On safety of agricultural and forestry tractors and their trailers' are published on the official EEC web-site on the Internet for all concerned in the section 'Answers to the actual questions of implementing the technical regulations'.

For the purposes of implementing the CU technical regulations 'On safety of agricultural and forestry tractors and their trailers' Decision # 277 by the EEC Board dated 26 November 2013 approved the Programme on design (amendment, revision) of the cross-border standards which, if voluntarily applied, result in meeting the requirements of the CU technical regulations 'On safety of agricultural and forestry tractors and their trailers' and also the cross-border standards containing rules and methods of analysis (tests) and measures, including those of sampling needed to apply and implement the requirements of the CU technical regulations ‘On safety of agricultural and forestry tractors and their trailers’ and make the products compliance assessment (validation).
