EEC Board adopted decisions on customs value

The Eurasian Economic Commission’s Board amended the Regulation on peculiarities of customs value control at its meeting held on April 6.

The Commission’s decision being in force contemplates that repeated deliveries of the same goods should not be subject to in-depth control of the customs value, provided that the reliability of the customs value of the initial batch has been confirmed. Along with that, all shipments of goods should be declared at the customs in one customs authority.

Considering the development of information exchange between customs authorities, such a condition as the need to declare all shipments of goods in one customs authority has been excluded.

Peculiarities of applying this mechanism if the goods are released prior to submitting the declaration for goods were taken into account as well.

The EEC Board also amended the Procedure for deferred determination of the customs value of goods.

It bears reminding that the possibility to defer determination of the exact customs value has been stipulated by the EAEU Customs Code. This enables the importers to pay customs duties based on actual cost of the goods without applying estimating methods of determining the customs value.

The EEC’s decision being in force determines the cases and the procedure for applying such a mechanism. Nowadays, the possibility is provided to determine the exact customs value in three cases.

The procedure has been supplemented by another case where it is possible to defer determination of the exact customs value – if the price of goods depends on its quality characteristics determined by results of the goods’ research or analysis conducted after their import.
